Gibbar Wills and Probate

THOMAS FINCH was our 3x Great Grandfather through the Gibbar line. Thomas' parents and location of birth are currently unknown. He was married to Nancy (nee Unknown) Finch and had two daughters, Catherine and Harriet (our 2x great grandmother) and three sons, Thomas Jr., John and George.

Thomas Finch died in Perry County, Missouri sometime between the recording of the Will below on May 20th, 1820 and July 16, 1821, the date that his wife, Nancy Finch, was given her duties as Executrix of the Will. The location of his grave is unknown, but likely in Perryville, Perry County, Missouri.

Thomas Finch Will

In the name of God Amen. I Thomas Finch of the Territory of Missouri and County of St. Genevieve being weak in body but of a sound mind and perfect memory do make ordain and declare this instrument to be my last will and testament revoking all others to my dearly beloved wife Nancy Finch, I give and bequeath the use and profit and benefit of my hole estate real and personal for the term of her natural life except such such parts thereof as are specially disposed of hereafter. To my youngest daughter Harriet. I give and bequeath my negro girl by the name of Hannah which is to be free at thirty five years of age to my Daughter Catharine Quick I give a bequeath my negro girl by the name of Patience, my Negro woman Winna it is my will and desire shall receive her freedom the twenty fifth of December next. It is my will and desire that my Negro woman, Meriah and negro girl Betey shall receive their freedom at the ago of thirty five, upoin the decease of my wife it is my will and desire that the negro woman Meriah and negro girl Bettey and all the remaining property be equally divided between my three sons Thomas, John and George Finch. Lastly I constitute and appoint my dearly beloved wife Executrix of this will and testament. In witness of all and each of the things herein contained I have set my hand and seal this twentieth day of May in the year one thousand eight hundred and twenty.

State of Missouri Perry County. On the sixteenth day of July Eighteen hundred and twenty one there came Baranbas Burns and John Morris the two subscribing witnesses to the foregoing last will and testament of Thomas Finch late of St. Genevieve County now Perry County deceased and severally made oath, that they did see Thomas Finch sign and seal said will, and that they heard him publish pronounce and declare the same be his last will and testament, that at the time of his so doing he was to the best of their apprehension of sound and disposing mind memory and understanding, and that they subscribed their names to said last will and testament as witnesses in the presence of the said testator and in presence of each other sworn to this 16th day of July 1821 before me [C M Slattery signature], Clerk of the County Court. Know all men by these presents, that I Nancy Finch as principal and Tunis Quick and John W. Quick as sureties acknowledge ourselves to be indebted unto His Excellency Alexander McNair Governor of the State of Missouri, and his successors in Office in the just and full sum of twenty four hundred dollars lawful money of the United States, to the payment of which well and truly to be made, we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents, sealed with our seals and dated at Cinque Hommes this twentieth day of July in the year of our Lord, one thousand eight hundred and twenty one. the condition of this obligation is such That if the within bounden Nancy Finch administratrix of the last will and testament of Thomas Finch deceased, do make or cause to be made a true and perfect Inventory of all and singular the goods, chattels, rights and credits, which have or shall come to the hands, profession or knowledge of her the said Nancy Finch or into the hands or profession of any other person or persons for her and the same so made, do exhibit or cause to be exhibited into the Office of the County Court for Perry County, at and before three months from and after the date of the letters testamentary and the same goods, chattels, rights and credits of the said deceased at the time of the death of the said deceased, or which at any time shall come to the nads or profession of the said Nancy Finch or into the hands or profession of any other person or persons for her do well and truly administer and dispose of according to law and the directions of the said last will and testament and shall in all other respects faithfully execute the said last will and testament according to the true intent and meaning thereof, and the law shall direct, and further do make or cause to be made a just account of her executorship at or before the twentieth day of July 1822 and all the rest and residue of the said goods, chattels, rights and credits which shall be found remaining upon the Nancy Finch, account the same being first allowed by the

 County Court for the County aforesaid, and shall deliver and pay to such person or persons as the said will shall direct, and according to law, then the above obligation to be void and none effect otherwise to remain in full force and effect.

Perry County Clerks office. I Nancy Finch do solemnly swear that I will well and truly perform the last will and testament of Thomas Finch deceased late of the township of Cape Cinque Hommes County of St. Genevieve by paying first his debts and then the legacies contained in the said last will and testament, as far as his goods, chattels, rights and credits will extend, and the law charge me and that I will make a true and perfect Inventory of the said goods and chattels rights and credits, as also a just account when thereunto required. Nancy Finch swore and subscribed to before me this 20th day of July 1821.

I, CM Slattery, Clerk of the County Court within and for the County aforesaid to all to whom these presents shall come Greeting: Whereas the last will and testament of Thomas Finch deceased hath been proved and Nancy Finch the Executrix therein named hath taken the proper oath and given bond with securities of all power is therefore granted to the said Nancy Finch to administer according to law, all and singular the goods chattels, rights and credits of the said deceased, and well and truly to perform the last will and testament of said testator by paying first his debts, and then the legacies contained in the said last will, as far as his goods, chattels, rights, and credits will extend and the law charge her and the said Nancy Finch is hereby acquired a true and perfect inventory of all the said goods chattels rights and credits and the same to exhibit into the Office of the said Court at or before the twentieth of October next ensuing and to make a true and just account of her administration at or before the twenty eighth day of July next in the year Eighteen hundred and twenty two and also to make settlement with said Court, at least once in every year, until her duties be fully completed.
