Gibbar Wills and Probate

SIMON HAGER was our 5X Great Grandfather through the Gibbar line. He was born approximately 1763, at Hager's Ferry, Tryon (later Lincoln) County, North Carolina to George Hager and Crate Killian. He was a patriot and served in the Revolutionary War. Simon was married to Elizabeth (nee Lawing) Hager. His children included Catherine (nee Hager) Smith, Sarah (nee Hager) Frost, Mary Elizabeth (nee Hager) Rudesil, William Hager, John Hager, Barbara (nee Hager) Elders, and Frederick Hager (our 4x great grandfather).

Simon Hager died on January 28, 1835. There is a tombstone marking his death located in the Stroup-Hager Family Cemetery in Bessemer City, Gaston County, North Carolina.

Last Will and Testament  - April 7, 1828

"In the name of God, Amen.

I, Simon Hager of the County of Lincoln, State of North Carolina, being weak and feeble of body but of sound and disposing mind memory and judgement for which blessing I desire to return my most devout acknowledgement to the great giver of good have judged it proper while possessed of the use of reason, so to dispose of my worldly estate as to me appears just and reasonable; and do therefore make and declare my last will and testament in manner and form following hereby revoking all former will or wills by me made heretofore made. First, I give and bequeath to my beloved wife Elizabeth Hager twelve acres of land including my dwelling house, out buildings and spring, during her natural life, and all my household and kitchen furniture including beds, chests, tables and all, and everything whatsoever that may be in the house belonging to me, together with a bay mare called Fance and her choice of two cows out of the stock and all my stock of hogs and sheep, together with the entire benefit of the orchard and fruit trees. 

I give and bequeath to my son Frederick Hager the sum of 5 dollars. I give and bequeath to John Elders the sum of one dollar. I give and bequeath to my daughter Catherine Hager my loom and all the tacklings belonging thereto together with the priveledge of a residence or home on my land so long as she remains unmarried. I give devise and bequeath to my sons, John and William Hager all the lands belonging to me, to be equally divided between them, the upper part of the plantation on which I now live to be laid off for John Hager, and the lower part for William. The tract containing one hundred and ninety five acres adjoining James Brown to be equally divided between the said John and William Hager. I further direct and order that the said John and William Hager shall equally provide yearly for their mother's support the following articles namely, eight bushels of wheat, twenty bushels of corn, one hundred weight of pork and ten pounds of coffee and ten pounds of sugar. I further give and bequeath to my sons John and William Hager my waggon [sic], gears and farming utensils either as joint property or to be equally and shared between them. I also devise and bequeath unto John and William. Hager in equal parts a tract of land adjoining Jacob Rudisell, containing fifty acres for which I gave an obligation to convey to my son Frederick Hager; on condition the said John and William Hager pay to Frederick Hager the sum of twenty dollars which he the said Frederick Hager has agreed to receive as compensation for the same. I give and bequeath to my daughters Barbara Elders, Sarah Frost, Mary Rudisell and Catherine Hager the sum of five dollars each, together with an equal share of what ever property may remain after my wifes death, excepting the land, which shall belong to my son William. The other property to be sold and divided as above directed. I likewise constitute, make and ordain my son-in-law John Rudisell and Abraham Mauney joint executors of this my last will and testament. In witness whereof I have hereunto set my hand and affixed my seal this 7th day of April in the year of our Lord one thousand eight hundred and twenty eight.
